On the earlier XL brake that uses the spacer in your pic, the swingarm has a wide slot in which that spacer floats, providing the anchor for the backing plate.
Now, here is the crux of your problem:
The later XL swingarm had a narrower slot through which a bolt was installed into the brake shoe anchor inside the backing plate. That set-up is the type your frame is replicating. This requires careful shimming between the inside of the axle plate and the backing plate so that the brake works properly without binding. You may discard the spacer in your pic, add enough spacer between the frame and brake, and add a washer and nut on the outside of the axle plate. If the stud is not long enough to accomplish this, you can swap in a late brake shoe anchor, which has a threaded hole instead of a stud.
OR, you can make the slot in the axle plate wide enough for your spacer to float (and you may have to add material to the inside of the axle plate to give the spacer sufficient purchase).
Look at the repair manuals for early and late XL brake set-ups, there are pictures of each that should make things clear.

The alternative of swapping a later brake shoe anchor into the backing plate would be easier.

It needs to be a slip fit on the spacer in your hand in the first pic. Scribe the lines, and use a die grinder to widen the slot, and file to the final size. You will probably have to add material on the inside of that axle plate so that spacer will have a wide area to bear against. Some 1/4 or 3/8 square stock or key stock would probably do it. Weld securely and finish size with a file.
The alternative of swapping a later brake shoe anchor into the backing plate would be easier.
