i have a 79 sporty with a hih hardtail. i'am using the stock axle and rear wheel
with a softail caliper. my question is when you tighten the wheel up should the caliper be able to move.

What era Softail caliper are you using? If it's the 4 piston, 2000-up style, then no, the caliper won't move once the axle is tight. The part of the caliper that the axle goes through acts as a wheel spacer, so it has a clamp load on it when the axle nut is tightened down.

thats what i thought thanks--so heres my next question if it is already
being held by axle clamp load how bullet proof does the stay half to be how
much force is against the stay

I would make the stay strong. Harley makes it out of 3/16" steel welded to the swingarm if that tells you anything. I'd rather it be a bit stronger than it needs to be than worry about it snapping off under braking load.
